Call for Volunteers: Enteral Sedation Permit Holders

The CDA needs a few members who currently provide enteral sedation services and would be interested in providing their perspective in a focus group. The focus group would include both general dentists and specialists that represent a broad range of perspectives on the proposed anesthesia rule. The CDA plans to gather information and ideas from this group to take to the State Board.

State Board Returns Anesthesia Rule to Committee

On Thursday, July 9, the Colorado State Board of Dental Examiners (SBDE) held a public hearing on the proposed rule addressing anesthesia permits and administration.

Numerous dentists and patients attended the hearing and relayed their concerns about the rule proposal to the State Board.

Several testimonies were presented at the hearing. Some were supportive of the rule proposal and simply requested a few clarifications. Others vehemently opposed the rule, most frequently contesting the rule proposal's potential impact on oral sedation permits and expressing concern about patient access to oral sedation services should the new rule be implemented. Dr. David Lurye, president of the Colorado Dental Association, testified regarding the range of concerns conveyed to the CDA by its members.

HCPF Fluoride Claims Adjustment

Attention Medicaid Providers: The Department of Healthcare Policy and Financing contacted the CDA today wanting to inform members of a temporary system glitch in the Medicaid system. The computer error is denying dentist providers the fluoride varnish (D1206) reimbursement.

The Medicaid office is quickly rectifying this situation. Claims for these codes submitted under fee-for service that have been denied will be "mass adjusted" to pay in approximately 10 days.

State Board Revises Anesthesia Rule Proposal

The Colorado State Board of Dental Examiners (SBDE) has issued a new draft of the proposed rule on anesthesia permits and administration. The revised rule proposal includes new sections that outline how the Board intends to transition current licenses and further detail the requirements for nitrous oxide administration. It also makes some editorial changes for clarification.

State Board Revises Anesthesia Rule and Permit Structure

The Colorado State Board of Dental Examiners (SBDE) recently revised its rule on the administration of anesthesia in an attempt to better define and clarify the permit structure. The proposed rule would reduce the four current anesthesia permits to two proposed permits. The new rule is based on an "anesthesia continuum" that ranges from local to general anesthesia, and focuses on the sedation level of the patient rather than on specific drugs or routes of administration. Requirements become more stringent as one progresses to deeper levels of sedation on the continuum.

Under the new rule, licensed dentists could provide local anesthesia, analgesia and anxiolysis without a permit. In most cases a permit would not be required for nitrous oxide applications performed by a dentist.

ADA Hires New Executive Director

Kathleen T. O'Loughlin, D.M.D., M.P.H, has been selected by the American Dental Association Board of Trustees to serve as the next ADA Executive Director/Chief Operating Officer, effective June 1, 2009. Dr. O'Loughlin becomes the first female executive director in the ADA's 150-year history.

Red Flags Rule Postponed for 90 Days

Federal Trade Commission (FTC) regulations require any business that may provide credit to customers to develop written plans to prevent and detect identity theft. The FTC has deemed dentists and physicians as creditors who are subject to the rule when they don't receive payment in full from their patients at the time of treatment.
